Terms of Service
These Terms of Service ("Terms") govern your access to and use of WorkConfirmed's websites, applications, and services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms. If you are using WorkConfirmed on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Service.
1. What WorkConfirmed Does
WorkConfirmed provides tools that allow service businesses to document completed work, request confirmation from customers, and display qualifying completed-work records in a public portfolio.
WorkConfirmed is not a review website, contractor licensing authority, inspection service, warranty provider, escrow service, marketplace, or certification body.
2. Meaning of "Customer Confirmed"
A project identified as Customer Confirmed means that a customer or recipient completed the applicable WorkConfirmed confirmation process indicating that the project presented to them represents work completed for them.
Customer Confirmed does not mean that WorkConfirmed:
- inspected the work;
- independently witnessed the work being performed;
- verified workmanship, quality, completeness, safety, code compliance, or legal compliance;
- verified a contractor's license, insurance, qualifications, or credentials;
- verified every factual statement supplied by the service business;
- guarantees that a customer is satisfied with the work;
- endorses or recommends the service business;
- provides a warranty or guarantee regarding the project or service provider; or
- resolves disputes between a customer and service business.
WorkConfirmed records the occurrence of the confirmation process. Responsibility for the underlying work and representations about that work remains with the service business.
3. Business Accounts
You must provide accurate information when creating and maintaining a WorkConfirmed account.
You are responsible for maintaining the confidentiality of your account credentials and for activities occurring through your account.
You may use the Service only for lawful business purposes and only in connection with businesses and projects you are authorized to represent.
You must promptly notify WorkConfirmed if you believe your account or access credentials have been compromised.
4. Project Records
Businesses and their authorized users may submit project information including descriptions, service categories, dates, locations, photographs, and related information.
By submitting a project, you represent and warrant that:
- the project relates to actual work performed by your business or under your authority;
- the information you provide is accurate to the best of your knowledge and is not intentionally false or misleading;
- you have the rights and permissions necessary to submit the photographs, descriptions, and other content;
- your submission does not unlawfully disclose another person's confidential or personal information;
- your submission does not infringe intellectual property, privacy, publicity, or other rights of another person; and
- you will not attempt to fabricate, manipulate, purchase, or fraudulently obtain a Customer Confirmed record.
You remain responsible for the accuracy and legality of content submitted through your account.
5. Customer Contact Information and Confirmation Requests
A business may provide a customer's email address or mobile telephone number for the purpose of requesting confirmation of a project.
By providing customer contact information, you represent that you are authorized to provide that information to WorkConfirmed and that you have any permission or consent required by applicable law to use the information for the requested communication.
You may not use WorkConfirmed to send confirmation requests to individuals who are unrelated to the project, to generate fabricated confirmations, to harass recipients, or to send unsolicited commercial advertising unrelated to the WorkConfirmed confirmation process.
WorkConfirmed may limit, suspend, or block confirmation requests that appear abusive, fraudulent, excessive, or inconsistent with these Terms.
6. Customer Confirmation
Customers are not required to leave a review, assign a rating, publicly identify themselves, or express an opinion about the service business in order to confirm a project.
A confirmation reflects the customer's response to the project information presented through WorkConfirmed at the time of confirmation.
Customers may also privately indicate that information is inaccurate, incomplete, or otherwise needs attention. Such responses are provided to the applicable business and do not constitute a public review through WorkConfirmed.
WorkConfirmed may retain technical and confirmation evidence reasonably necessary to protect the integrity of Customer Confirmed records.
7. Public Portfolios
Qualifying Customer Confirmed projects may be displayed publicly through a WorkConfirmed portfolio.
Public project information may include information such as the business name, project title and description, service category, general city and state, completion date, photographs, and confirmation status.
WorkConfirmed does not intentionally display customer email addresses, customer telephone numbers, customer street addresses, private issue responses, or submitter identities as part of a public portfolio.
Businesses are responsible for ensuring that project photographs and other public project content are appropriate for public display.
8. License to Business Content
You retain ownership of content you submit to WorkConfirmed.
You grant WorkConfirmed a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, resize, transmit, and display that content as reasonably necessary to provide, secure, operate, and promote the functionality of the Service and your WorkConfirmed portfolio.
This license continues for as long as reasonably necessary to operate the Service and maintain applicable project and confirmation records, subject to applicable law and our Privacy Policy.
You represent that you have the rights necessary to grant this license.
9. Acceptable Use
You may not use WorkConfirmed to:
- create fake or misleading project records;
- impersonate another person or business;
- submit work that did not occur;
- falsely represent a customer's confirmation;
- manipulate or interfere with the confirmation process;
- attempt to bypass access controls, security measures, rate limits, or project protections;
- scrape or systematically extract data from the Service without authorization;
- introduce malicious code or interfere with operation of the Service;
- violate applicable law or another person's rights; or
- use the Service in a manner that could damage WorkConfirmed, its users, or the integrity of Customer Confirmed records.
We may investigate suspected misuse and may remove content, restrict functionality, suspend accounts, or terminate access where reasonably necessary to protect the Service or its users.
10. No Endorsement of Service Providers
The presence of a business or project on WorkConfirmed is not an endorsement, recommendation, accreditation, or certification by WorkConfirmed.
WorkConfirmed does not guarantee the qualifications, licensing, insurance, reliability, legality, workmanship, pricing, conduct, or performance of any service provider.
Customers and prospective customers remain responsible for evaluating service providers and determining whether a provider is appropriate for their needs.
11. Service Availability and Changes
WorkConfirmed is an evolving service. We may modify, add, remove, suspend, or discontinue features from time to time.
We do not guarantee uninterrupted or error-free operation, permanent availability of any particular feature, or that every communication or confirmation request will be successfully delivered.
We may perform maintenance or take action necessary to maintain security, reliability, legal compliance, or the integrity of the Service.
12. Beta and Pre-Release Features
WorkConfirmed may make beta, pilot, experimental, or pre-release functionality available from time to time.
Such functionality may be incomplete, change without notice, contain errors, or be discontinued.
You should not rely on beta functionality as your sole recordkeeping, compliance, customer communication, or business continuity system.
13. Third-Party Services
WorkConfirmed relies on third-party infrastructure and service providers for functions such as hosting, authentication, database services, email delivery, telecommunications, and verification.
We are not responsible for outages, delays, changes, or failures caused by third-party services outside our reasonable control.
The Service may also contain links to third-party websites. WorkConfirmed does not control and is not responsible for those websites or their content.
14. Intellectual Property
Except for content submitted by users, WorkConfirmed and its software, branding, design, text, graphics, logos, functionality, and other proprietary materials are owned by WorkConfirmed or its licensors and are protected by applicable intellectual property laws.
These Terms do not grant you ownership of WorkConfirmed's intellectual property.
You may not copy, reproduce, distribute, sell, license, reverse engineer, or commercially exploit protected portions of the Service except as permitted by law or with our written permission.
15. Feedback
If you provide suggestions, ideas, or feedback about WorkConfirmed, you permit us to use that feedback without restriction or compensation to you.
16. Suspension and Termination
You may stop using WorkConfirmed at any time.
We may restrict, suspend, or terminate access if we reasonably believe an account is violating these Terms, creating security or legal risk, abusing the Service, engaging in fraudulent activity, or threatening the integrity of Customer Confirmed records.
Certain provisions of these Terms that by their nature should survive termination will remain effective, including provisions concerning ownership, licenses, disclaimers, limitations of liability, and legal obligations.
17. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
WORKCONFIRMED DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY OTHER WARRANTIES THAT MAY OTHERWISE ARISE BY LAW, COURSE OF DEALING, OR USAGE OF TRADE, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.
WORKCONFIRMED DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT INFORMATION SUBMITTED BY USERS WILL ALWAYS BE COMPLETE OR ACCURATE.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKCONFIRMED AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS, LOSS OF DATA, OR LOSS OF GOODWILL ARISING OUT OF OR RELATING TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKCONFIRMED'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO WORKCONFIRMED DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
These limitations apply only to the extent permitted by applicable law.
19. Indemnification
To the extent permitted by law, if you use WorkConfirmed on behalf of a business, you agree to defend, indemnify, and hold harmless WorkConfirmed and its owners, officers, employees, contractors, and affiliates from third-party claims, damages, liabilities, costs, and reasonable expenses arising out of or relating to:
- content submitted through your business account;
- your underlying services or work;
- your violation of these Terms;
- your violation of applicable law or another person's rights;
- your use of customer contact information; or
- fraudulent or misleading activity conducted through your account.
20. Privacy
Our collection and use of personal information is described in the WorkConfirmed Privacy Policy, available at /privacy.
21. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles, except where applicable law requires otherwise.
Any dispute that is not otherwise required by applicable law to be heard elsewhere will be brought in a court of competent jurisdiction in California.
22. Changes to These Terms
We may update these Terms as WorkConfirmed evolves. When material changes are made, we will update the effective date and provide additional notice when appropriate.
Your continued use of the Service after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
23. Severability
If any provision of these Terms is determined to be unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.
24. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms expressly agreed between you and WorkConfirmed, constitute the agreement between you and WorkConfirmed regarding use of the Service.
